Public Announcement

As it is known, our Directorate General purchases goods and services needed by public institutions and organizations within the monetary limit stated in Article 3/g of the Public Procurement Law No. 4734.

In the Official Gazette dated 28.12.2023 and no. 32413, the following additional article has been added to the Public Procurement Law dated 4/1/2002 and no. 4734;

“Purchases to be made by the Directorate General of State Supply Office on behalf of administrations

ADDITIONAL ARTICLE 12- Procurement of vehicles, vehicle rentals, the procurement of fuel and medicines, medical supplies and devices to be made by the Directorate General of State Supply Office on behalf of the administrations, can be made by such procurement procedures as open or sealed tender procedure in which all tenderers can submit their bids in written, restricted procedure in which tenderers, after they are sent invitations, submit their bids through open or sealed tender procedure, or negotiated procedure in which price negotiations are made with the invited tenderer on condition that transparency, competition, equal treatment, reliability, confidentiality, public scrutiny, meeting the needs on time and under favourable conditions and using the resources efficiently are ensured.

In purchases to be made within the scope of this article, the following provisions have been published.

  1. Framework agreements can be made provided that the procurement procedures specified in the first paragraph shall apply.
  2. The provisions of this Law shall not apply, except for the provisions about penalty, prohibition from participation in tenders and tender result announcement.
  3. The principles and procedures related to the work and transactions regarding the tender process and framework agreements including the procurement procedures to be applied, announcement and invitation periods and rules, preparation of documents, submission and evaluation of bids and the conclusion of procurements shall be determined by Directorate General of State Supply Office upon the opinion of the Public Procurement Authority.

From now on, the monetary limits stated in Article 3/g of the Public Procurement Law No. 4734 shall not apply in the procurement of vehicles, vehicle rentals, the procurement of fuel and medicines, medical supplies and devices to be made by our Directorate General, and transactions shall be made within the provisions of Additional Article 12.
